BOOKING A PHOTO-SHOOT
The requested date for a photo-shoot will be provisionally held until 2 weeks prior to the shoot. If no firm booking confirmation is given by this time the date will be released.

BOOKING FEE AND CANCELLATIONS
When a photo-shoot is booked a 20% booking fee is required to hold the date.
Asmartartz Photography is available Monday to Sunday. If a shoot is required on a Bank Holiday an additional fee shall be charged.

If the shoot is then cancelled with 2 or less weeks (14 days) notice before the date, the booking fee will be held as a non returnable cancellation fee.

Should the client fail to pay the booking fee within 10 days of being required to do so, Asmartartz Photography may treat the booking as having been cancelled by the client, and release the date.

CANCELLATION by PHOTOGRAPHER: If the Photographer has to cancel this contract for reasons beyond their control, for example including but not limited to death, injury or sickness, the Photographer's liability shall be limited to a full refund of all monies paid.

SETTLEMENT OF ACCOUNT
Full payment (minus booking fee) will be paid on the day of the photo-shoot by the client unless otherwise agreed. Monies will be taken before the shoot begins.
Asmartartz Photography terms for settlement of invoices which are forwarded to the client for payment are thirty days.
PAYMENT: The Client’s payment to the Photographer shall be as follows: A booking fee of 20% is due at the booking of the shoot. The remainder of the Photographer’s fee (Package price minus deposit) is payable on the day of the shoot. Travel expenses are to be paid no more that 14 days after receipt of invoice. Re-print and enlargement orders should be paid for in full at time of ordering.
HOURS OF PHOTOSHOOT
Should an event overrun from the times stated at the time of booking, an additional charge may be levied at the discretion of Asmartartz Photography. Any additional charges applicable can be found listed in the different packages available.

CLIENTS OWN EQUIPMENT AND BELONGINGS
Asmartartz Photography is in no way liable for any loss or damage to equipment or personal belongings taken to the locations or public areas during photo-shoots.

TRAVEL
The Client will be responsible for any additional travel costs, shipping and other reasonable costs related to the Photographer’s work that have not been included in the cost of the package. Travelling costs are 40p/mile from Surrey/Hampshire to the shoot location and return journey. Travel between venues will also be included. The London congestion charge, parking fees and toll charges will be included if applicable.

COOPERATION: The client and asmartartz photography consent to cheerfully cooperate and communicate with each other to achieve the best possible result within the understanding of this contract.

THE SCHEDULE: The shooting schedule, style of working and experience are designed to achieve a fun and treasured set of photos for you, accomplished with good humour and enjoyed by all concerned. Both the client and asmartartz photography therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the shoot does not run on time Asmartartz Photography cannot guarantee to take the normal set of photos although in such circumstances I will do my absolute best to compensate.

PHOTOGRAPHERS TIME & WORKING HOURS: The Photographer’s time specified in each package starts from the time the photographer arrives (unless otherwise stated) and continues until the allotted time is up. Unless otherwise agreed at the time of booking, the time may not be split up and must be taken as a single block. Any additional time must be paid for at the rate currently in force as specified in this contract above.

HOUSE RULES: Note the photographer is sometimes limited by rules imposed by venue management as to what can and cannot be done. For example some venues insist that no flash photography is allowed, and others will require a property release to be signed in advance, or may try and charge for the use of the chosen location. In such circumstances the client agree to accept the technical limitations that may be imposed on the equipment used and any additional unplanned charges levied. We advise the client to make themselves aware of the rules of the venue concerned and if necessary negotiate with the indium's concerned.

STYLE: The Photographer(s) will photograph the shoot in their style as shown through their website, and by booking a shoot with them, you are agreeing that you agree to their artistic interpretation and vision.
Prior to or during the event, the Client may inform the photographer of subjects which they would like photographed, but the final content of the images is at the discretion of the Photographer. When using digital photography, the Photographer(s) will be under no obligation to display the images while the event is still underway.

LIMIT OF LIABILITY: If the photographer is too ill or becomes injured and cannot supply the photographic services specified above, asmartartz photography will do everything possible to re- book the shoot at a convenient time for the client. If a suitable time cannot be found in these circumstances, liability is limited to a refund of any monies received. This limitation on liability shall also apply in the event that images are lost through equipment malfunction, lost in the mail or otherwise lost or damaged without fault on the part of the Photographer. In the event that the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the Photographer’s fee.

COPYRIGHT LAW: English Copyright Law states that the copyright of photographs remains with the photographer. The Client is granted a license to use the images for personal use. The Client may also use the images in the Client’s personal web site and the personal web sites of the Client’s friends and family. The Client may not assign or transfer this license.

THE BOOKING DETAILS: The Client agree that they are responsible for providing all of the correct details regarding the date, time and each address the Photographer should attend. They also agree they have responsibility to check that all building names, street, road and postcode details match. If the Photographer arrives at a postcode, building, street or road given by the client, the Photographer will be deemed to have arrived at the correct address. Should the correct postcode be disputed, the correct postcode will be as defined by the Royal Mail.


Backup: The Photographer will aim to maintain backup copies of the images in her archive for a period of 5 years.

Asmartartz Photography reserves the right to use any photograph taken deemed appropriate, for the use in advertising and marketing for the promotion of asmartartz photography, on both the website and any other marketing material produced.
